California continues to tighten its already stringent gun control measures under the leadership of Governor Gavin Newsom. On Tuesday, Newsom signed several new pieces of legislation, including SB 899 and the 2024 Animal Protection and Gun Violence Prevention Act, further expanding the state’s gun restrictions. This move comes despite California having the second-highest number of gun-related deaths in the nation in 2022, according to the Centers for Disease Control and Prevention (CDC). These new laws, rather than enhancing public safety, primarily burden responsible, law-abiding citizens while doing little to deter criminals who disregard the law.
Targeting the Innocent
One of the key components of the new legislation allows courts to issue gun violence restraining orders based on behaviors such as stalking, animal cruelty, and threats of violence. Additionally, individuals deemed mentally incompetent to stand trial on misdemeanor charges will now face firearm bans—a provision that previously applied only to felony cases. While these measures aim to prevent potential violence, they also infringe upon the rights of individuals who pose no real threat to society, stripping them of their Second Amendment rights without due process.
Cracking Down on “Ghost Guns”
The new laws also address the proliferation of “ghost guns” – homemade firearms that do not have a serial number (which are completely legal to make at home). The legislation prohibits the sale of firearms intended to be destroyed, a move that garnered bipartisan support in the state legislature. However, the focus on these non-serialized weapons does little to address the root issue: criminals who obtain firearms through illegal means. Law-abiding citizens who responsibly own and use firearms for protection, hunting, or sport find themselves further restricted while criminals continue to operate unchecked.

As a police officer serving in the San Francisco Bay Area, I’ve witnessed firsthand that the vast majority of firearms in the hands of criminals are obtained illegally. Criminals do not adhere to gun laws, rendering these restrictive measures ineffective in reducing gun violence. Instead, they place an undue burden on law-abiding citizens, making it harder for them to exercise their constitutional rights. The focus should be on enforcing existing laws and targeting criminals, not on creating more regulations that only serve to punish responsible gun owners.
Governor Newsom’s Promises vs. Reality
Governor Newsom has positioned himself as a champion of gun control, asserting that California’s stringent laws are essential in preventing the next mass shooting. However, the data tells a different story. Despite the layers of gun regulations, California still experiences one of the highest rates of gun violence in the country. Newsom’s assertion that California’s laws are effective is contradicted by the persistent gun-related deaths and the ongoing challenges the state faces with gun violence.
Economic and Social Consequences
The relentless push for gun control has broader implications beyond individual rights. California has become a symbol of overreach in progressive politics, leading to economic downturns as businesses relocate, and citizens move out of the state in search of more freedom. The streets are plagued with homelessness and crime, further straining public resources and diminishing the quality of life for residents. Instead of fostering a safer environment, these excessive gun laws contribute to the state’s problems by neglecting the real perpetrators of violence.
The Second Amendment Under Siege
Pro-Second Amendment advocates rightly criticize the trend of using restraining orders to revoke gun rights based on accusations rather than convictions. This expansion of restrictive laws threatens to erode constitutional protections without addressing the core issue: criminals who inherently disregard the law. Responsible gun owners should not be penalized for the actions of a few, and policies should reflect this fundamental principle.
Legal Challenges and Future Implications
Many of California’s new gun laws face significant legal challenges, with courts increasingly striking down provisions that infringe upon constitutional rights. As Governor Newsom seeks to position California as a leader in gun control, the resistance from gun rights advocates continues to grow. For Second Amendment supporters, these laws represent a dangerous path toward the erosion of essential freedoms without effectively tackling the true sources of gun violence.
